1. Overview

3. Counter-Notification Procedure

If you believe that material you posted was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to our designated copyright agent. To be effective, a counter-notification must include all of the following.

3.1 Required Elements of a Counter-Notice

  • Your physical or electronic signature.
  • Identification of the material that has been removed or disabled, and the location at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your full name, mailing address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the applicable court and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

3.2 Processing Your Counter-Notice

Upon receipt of a valid counter-notification, we will forward a copy to the original complainant and inform them that we may restore the removed material in ten to fourteen business days unless the complainant notifies us that they have filed a court action. We reserve the right to restore the removed material at our sole discretion following the applicable waiting period.

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Domain has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. Domain may also, at its sole discretion, limit access to the service or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

5. Accuracy of Notices

Please be aware that under applicable law, including the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees incurred by the alleged infringer, by any copyright owner or copyright owner's authorized licensee, or by us, if injured by such misrepresentation.
